Case Reviews for Merit

Determining whether a matter has sufficient clinical substance before incurring trial costs is critical. Our OT and rehab specialists provide an objective “green light/red flag” analysis to help you decide whether to proceed, settle, or redirect resources.

Our Case Reviews for Merit include:

Objective, Evidence‐Driven File Analysis

  • Review all medical charts, therapy notes, diagnostic imaging, surgical reports, and expert depositions.
  • Identify any gaps in care or documentation that could undermine causation or liability.
  • Apply recognized clinical benchmarks (AOTA Practice Framework, state practice acts) to evaluate whether the claimant’s therapy needs, functional deficits, and projected care align with accepted OT standards.

Functional Limitations Summary

  • Synthesize objective evidence of ADL/IADL deficits, cognitive‐perceptual impacts, and psychosocial factors.
  • Highlight which limitations clearly stem from the incident or injury and which may be pre‐existing or unrelated.

Standard of Care & Causation Opinion

  • Offer preliminary opinions on whether treating providers met accepted OT practice guidelines (e.g., timely evaluations, appropriate interventions, measurable goals).
  • Identify any potential breach of care that could strengthen—or weaken—causation arguments.

Cost & Care Projections

  • Estimate past care costs (therapy visits, durable medical equipment, home modifications) based on published fee schedules and geographic adjustment factors.
  • Provide high‐level future cost projections for ongoing OT, DME replacements, home modifications, and caregiver assistance.

Concise Merit Memorandum

  • Deliver a 10–15 page written memo summarizing:
    • Key clinical findings
    • Red flags or strengths of the claim
    • Preliminary causation opinions
    • High‐level cost estimates
    • Recommendations for next steps (further investigation, additional records requested, or likely settlement range)
  • Include a 30‐minute follow‐up call to review findings, answer questions, and strategize.
